On papaer it sounds like a very good idea. I have canadian PR and I was also very tempted when I read this. But here are some disadvantages:
1. Windsor is a small place so hard for wife to find a job there.
2. Schools may not be the same quality as Toronto.
3. You might be putting your career in holding mode for another 1-2 years whereas you could do a much better job in Toronto.
Basically, my point is in order to try to wait for GC for another 1-2 years, you might have to compromise with your job/wife's job/kids education. I am at a point where I don't want to compromise with any of these if I move to canada. I want to make full use of the freedom of having a PR (take up whatever job/start a business/have wife take up whatever job/good school for kids etc)

Hi,
I may know the answer, but I thought i would check.
Below is my situation:
1) I-140 approved in Jan 2008
2) I-485 pending since July 2007
3) I have a 2 year EAD
Now, if I switch my job and the new employer is not ready to transfer my H1-B, can I use my EAD to work(provided my I-140 is not revoked by the previous employer)
Also, any chance that I could keep my GC application alive? what will happen when my Priority date becomes current.

UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.

I was in similar situation last year. This what my attorney told me after layoffs. They have to wait 6 months after layoffs in the company before filing PERM again. The perm filing process in big companies take atleast 2-4 months. So if they are planning to file after 6 months then this is right time to start collecting documents. For this to happen it might need little push from your manager.
If your company is in a situation where they are planning to layoff people continously over the next year(I know one big company which is doing this) then it is better to talk to lawyers right now and decide the course of action because there is no point in waiting until april. If your manager strongly supports your case then some times lawyers can pull off tricks like there are no layoff with this particular skill set or in this division etc..
I dont know of any big company that is hiring. If your resume is hot(has specialized skills) then put it in dice or monster you will always find employer.
You can always switch to consulting and find consulting company which applies for GC right away.

I say try to get as many shots as possible at your PCP. For TB and HIV tell him that you have been to India lately and want to make sure everything is okay. For other shots tell him that you are considering to apply for a medical/dental school and need to get vaccination records, which you don't have because everything was done in India. Take all those proof to immegration doctor, he will accept those records.
My wife in fact joined dental school last year. She needed only HIV.

I had my I140 approved too and had mentioned it in my application. They dont bother you. They however gave me 221g to verify student status and delayed my visa for two weeks. Interview was less than 2 mins and the vo said she had to verify student status thats it.

I am in a similar position and am going to wait till the end of the year for the AP. I am hoping to be able to go for the H1B stamping with the AP. So if there is any problem with the H1 I can atleast re-enter using the AP. Its a nice backup...

I think, if at all Minister is being planned to be met , it is better only few problems are presented to Minister.
PROBLEMS IN INDIA MAY DILUTE THE FOCUS. I think the following would be best to present ..
1) Retrogression.
2) Social Security Treaty.
Numbers justifying above data can do a lot good to explain the problem.
I think VISA retrogression problem can be addressed to the minister. That itself will give BIG relief to thousands of people from India.Make a special VISA Quota for India is another good option. Minister can suggest this option to the US Officials and Senators ! He is scheduled to meet some US senators in DC and NYC.
This is great opportunity for poeple living in Maryland and DC area. It is easy to go and meet him personally ! Think about it guys....

I was trying to find out if there are any other options to record my departure date and returning I-94 when I leave US by LAND.
Looks like the only option for people leaving by Land is to send the I-94 to "ACS - CBP SBU". In my case, I will have to send this along with details proving my stay in Canada after leaving US.

My lawyer says "If we file the I-140 based on the LC-PERM, we would interfile it into your pending AOS, so your AOS would be pending based on the pending I-140 (NOT the withdrawn LC Sub)."
Is it possible to interfile if the PD is not current? My pending LC SUB and the PERM LC PD, both are not current. Please confirm whether it is true or not. This will help me make my case.

If both job (old and new) in same area, and new salary is "considerably" less than old salary, then it may be an issue. But it may be overcome, provided if you know the prevailing wage determination (not salary) of old job. Lets say if the PW for a level-3 engineer for your old job 50K at a particular county, and I-140 salary in your old job is 70K, and if you port to new job with new salary as 60K in same county, then it should not be an issue. Again, if USCIS does not buy this, you need to dispute. It needs extensive lawyering with DOL wage survey as a proof.

It is easy to give ideas and question others but is difficult to actually work for something. I urge chapter members to communicate with each other and organize a call.

It's all about money my friends. Legal are already paying taxes. What they want is all these 12 million people to pay taxes too. Once these ppl come forward and apply for legal visa they will be backloged and will keep paying fees and taxes. After 20 years another cycle.
