I got an update via CRIS
UPDATE: On August 5, 2008, we transferred this case to our NORFOLK, VA location for additional processing.
My current status: My case was filed as EB2 and the PD is Mar2006, so I am current for another 6 days (Oct 2006 is retrogressing to 2003).
I have talked to several of my friends and they said this update means an interview is in the works.
Do you guys agree?
If so, I had questions based on that. Me and my wife were planning to travel to India this December.
1) Will I still be getting an interview since my case is not going to be current starting OCT 2008?
2) In case we should expect an interview, should we wait till we finish the interview?
Any input would be appreciated.

My point was that it doesn't matter. It represents $1000/ per person, hardly enough to make a dent in poverty. We need sensible labor laws, a pro-business attitude, and that money will return to India.

How were you able to file in june 2007 when the dates were not current for eb3. They wont even accept the applications.

Hi,
I may know the answer, but I thought i would check.
Below is my situation:
1) I-140 approved in Jan 2008
2) I-485 pending since July 2007
3) I have a 2 year EAD
Now, if I switch my job and the new employer is not ready to transfer my H1-B, can I use my EAD to work(provided my I-140 is not revoked by the previous employer)
Also, any chance that I could keep my GC application alive? what will happen when my Priority date becomes current.

Q1) i am applying for the first time for my i-485 that requires i-693 form.
My question is, do i have to submit my i-485 together with my i-693, or do i have to apply first the i-485 form and then wait until i get a respond from the USCIS.
I was told that i am supposed to wait for the respond from the USCIS after applying my
i-485, and the USCIS will designate the doctors for my I-693, which means i cannot choose any doctors on my own. But in this reform , according to the users' discussion, so far i understand that you can apply for the i-693 form regardless if you have already applied for the i-485 form.
Q2) To simplify my second question, while i am applying for my i-485, and before its submission to the USCIS, can i start making an appointment with my local Surgeon?

Please share your experience with us when done.
Mine is already done last month. You may have to wait there for couple of hours if you go on weekend. But once your number comes, it will be very fast.
It takes
20 minutes - 1.5 hours - Waiting time
5 minutes for physical checkup
2 minutes for shots
1 minute for blood work and PPD
2 minutes to pay initial fee
48-72 hours for PPD results ( Since labs are very very busy, they may take upto 4 days to send them blood work report)
After 48-72 hours
30-40 minutes wait to show your ppd result
1 minute - Dr to see PPD result
10 minutes - for xray if ppd positive
5 minutes - other shots if your blood report says so
5-10 minutes - for dr to read x-ray
2 minutes to pay for remaining fees
30 minutes - wait to get your sealed envelop ( otherwise go next day)

I wanted to know if any one's online status changed after FP is completed.
I had an LUD on my record after my lawyer sent the clarification to USCIS. But the status remains the same as ".... Case in suspense". Did any one's status came to Pending or a less ominous one?

The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

Can any one tell me if I have used incorrect mailing address or is this status normal? Do I need to do anything about it?

Although I agree with you on principle...that cannot bring people in numbers. There will always be people who don't agree with each other. leadership involves channeling both parties energies, those who agree with me and those who don't agree. Sounding arrogant, feeling proud of what I did better than others and looking down upon people who don't agree with me, doesn't help me, right? Who am I to judge somebody's attitude and achievements?
While i whole heartedly agree with what you stated above i don't think this idea is going to work. IV certainly will not want to take the risk of anti-immigrants being part of the advocacy effort and skewing things on the day. Messing up before the representatives will not do IV's credibility and good.
Infact all the donars in this site who keep asking me for donations would not want even me to be at the advocacy even if i donate, seeing how i disagree with them on principle. They would not want to risk me being part of the advocacy group
If i who believe in IV but does not believe in the approach as the approach does not provide relief to badly retrogressed categories is a risk for advocacy then the risk of anti immigrants being part of advocacy is even bigger
On a side note it is good to see some one from EB2 having a rational argument and calling a spade a spade

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.
I think H1B expenses must be paid by employer. However, GC fees need not be... as GC is an optional element (employer is not required to process GC for every H1B employee).

Perhaps your old employer might have withdrawn/ revoked your I 140 and that might have triggered the RFE. Still all they will ask is new EVl with job responsiblities so easy to answer

just got email from CRIS that my 485 has been transferred to TSC as my 140 was approved last year from TSC
How did you got your RN and ND. Did you call USCIS? or got from your Attorney?
I filed on July 23rd and signed by R. Pitcher at 9.29 AM and no news so far.

He will be out of status. Your 3 year extension beyond the allowed 6 years is based on that LC/I-140 from which your I-485 was filed. If the I-485 is rejected you have no right to stay beyond 6 years.
It is best to not use more than 3 years of H-1 if you have a pending I-485. That way you have 3 more years of H-1 in case you get rejected. The pending I-485 gives you unlimited time in the form of EAD/AP. Dont waste your H-1 time.
It only makes sense to keep H-1 while you have AOS if your country of chargeability is ROW, which is usually current. If your country is backlogged, it will most likely extend your H-1 over six years. Please consult a proper immigration attorney before you do anything.
