nixster has been leading the effort on FOIA. I had sent a PM to him. It seems he is little bit busy since they just had a new born baby (week old) and would post an update about FOIA on the normal forums in a couple of days.

I have a 3 years Engineering diploma plus a 3 year Engineering bachelor degree. We were given an advance standing in B.Tech (4 years for people with 10+2) and we completed it in 3 years. So it is 10+3+3 = 16 years of education. (I am from India)
My Attorney thinks this might be a problem at NSC at I140 in EB2 because of a 3 year degree. But it (B.Tech) is in fact a 4 year degree, and we were allowed to finish in 3 years. After 1 st year we attend the classes with 3rd year students of 4 year program. Take same courses and same tests.
How can I convince my Attorney and TSC that it is equivalent to a 4 year BTech degree in India and equivalent to US bachelor degree ?
I guess confusion arises from the fact that NSC does not recognize a 3 year BSc+ PG diploma from NIIT as equivalent to US BS degree.
Edit : My education evaluation was done by TrustForte. Are there any other evaluators that are more familiar with Indian Education system and also trusted by USCIS ?

They can follow to Join route if they marry one day before approval.

Guys,
I just called Air India customer service to ask about Transit Visa requirement at Frankfurt.
The guy on the phone told me that the Transit Visa is not required at Frankfurt. I specifically asked him about Transit Visa requirement for people travelling on Advance Parole. He replied saying that in any case, Transit Visa is not required at Frankfurt.
I guess the information on Air India website is regarding the London Transit visa as the Air India flights were used to travel Via London till 5 years back.
And that information might not be updated in last 5 years.

Well .. your guess is as good as mine. I haven't heard anyone talk about us or even acknowledge the fact that legal immigration is broken to a point where it's becoming simply hopeless. In fact I believe it was Kennedy who said that there is no need to improve the current legal immigration system. There was hundreds of hours of discussion on the TV about the immigration but I hardly heard anything about the reform in the legal immigration system. America's fascination and love with the illegals probably has created the problem of illegal immigration today as we see it. Good luck solving it.
Time and again illegal folks have been given the benefit of the doubt and awarded with amnesty. When was the last time U.S. government said that okay legals.. you don't have to wait in line for half of your life to get your GC... here it is and now go have fun.

What happened finally with the hard country limit? Looks like that still made it through without any amendments. That will only increase backlogs, atleast for EB3.
Is there some way we can push for an amendment when the bill reaches the house? Or during reconciliation between the house and senate bills?

I think there is not much harm here because the new law says any unused numbers in the previous year will be added to the 290,000 quota next year. So, even we don't get the numbers this year due to the per country limit, next year the size of the cake will be a lot larger.

Zheng, isn't the point of the whole exercise to decrease the wait? You'll wait another year, during which time even more people will have joined the queue.
If CIR is supposed to reduce backlogs and waiting times, this is not the way to do it.
I don't know about you but a year is a long time in my life. Esp after waiting for so many years already. Making me wait yet another year when there is no need for me to wait is HARM by my definition.

Today I received the screen shot from my employer and found out that following informations are missing:
Processing Type, Case Source and Data Entry assigned to
I would like to know the significance of the above missing informations and does it affect the labor approval process?
In the screen shot, case received date is 01/10/2005 and Case Status is Data Review.
Please let me know if these missing info can have any negative affect my case? And if answer is YES then what should I do?

Mmmm... Seven years sounds a bit long to me in this modern century. How about +5 years?
As I have mentioned before we need to be creative. Lobbying for a law or whatever that gives GC to H1B holders who are on H1B for more than 7 years is the easiest way out because this will not cause much grief - as these people are allready in USA and allready working and paying taxes for 7+ years and giving them GC will not increase the labour pool (which is the main concern for anti immigrant lobbies). Also providing GC to these people will unleash a wave of benefits to the local economy as these new GC holders will now confidently invest in the US economy.
We need somebody who is capable of carrying this message to the heart of the congress and the senators.
