nycgal369, I agree there are some merits to your point that Matloff's reform proposal would bring in some immediate benefits to some H1Bs. (Assuming as qplearn pointed out, the visa numbers are somehow made available)
That said, there are some worrisome points in his proposal, which is why the proposal will never get the backing of the business community:
(1) The 15 % limit. Why 15? Why not 10? Why not 25? The 15 % seems a totally arbitrary figure and does not take into account the overall size of the firm and the nature of its business. There are plenty of honest, non-exploitative firms working in specialized areas, with say 20-25 employees and 5 H1s. Matloff's proposal will enforce artificial ceilings dictated not by skill availability but by an completely arbitrary figure. (I know the 15 % is the figure currently used to identify an H1B dependent employer, but it does not have any restrictions associated with it)
(2) The Commission on Technical Guest Workers and the ability to file a discrimination complaint by any Tom-Dick-Harry who was pissed off at not being hired is an obvious trojan horse whose sole purpose seems to be to introduce as much bureaucracy and government interference in the hiring process as possible. Will any business entity or lobby support this? Not in this lifetime.
(3) On page 2, section 3, Matloff rails against the current system of prevailing wage determination and advertising open positions. Yet, in his proposals, he mentions a 30 day hiring window with DOL advertisements. No specification about the hiring and screening process is put forth. hmmmm ... curious.. I believe this is another trojan horse, an anchor point on which highly restrictive and impractical screening processes can be attached later during the legislative process.
Considering this, it is impossible any business lobby will support Matloff's proposal. As such we at IV are dependent on the business lobby to introduce bills since we on our own do not have the clout or money.
By going gung-ho for Matloff, we risk losing the business lobby in exchange for uncertain gains.

Another interesting debate (I read the entire thread) .. I really appreciate all, sharing your ideas how to solve this problem.

I too have seen at least 4 cases in my circle. All of them work for Desi Body shopping companies (with a head count of 20-150) and in all these cases their h1 extensions got denied after replying to RFEs. RFE details are not completly known but they are all about Company's financials.
In the 4 cases I came across, three of the candidates have EAD/APs...so there was no real impact. But in one case, the candidate did not even file for his 485. But luckily, the moment he saw the denial online, he approached another consulting company (this is bigger with strong financials) - they filed a H1 transfer based on his prior H1 reciept the very next day (as if they were not even aware of the denial). Luckily, he got his new H1 (transfer) approved in a week (premium).
Mine got denied last year for these reasons and i have been on EAD since then.
1. Petitioner is not in compliance with the terms and conditions of
employment.
2. Petitioner does not qualify as either an Employer or Agent - Not eligible
to file an H1-B Petition.
3. Petitioner is not an Agent.
4. Petitioner is required to submit a valid LCA for all work locations.
5. Position is not a Speciality Occupation.
Infact it is a 12 page denial letter, these are just bullet points of it.

Maybe some members can write to them asking them to look into this issue and work for the end of retrogression. You can mention ImmigrationVoice in your letter.

Before you criticize IV pls read all the posts written by us. Every now and then members demand updates. Well, the updates are on the homepage and the posts we write. There are media stories that have appeared recently. There are events we have been participating and there are action items like state chapters we want all members to participate.
Pls. ask yourself if you have signed up yet for the state chapters, contributed money and efforts, brought more members into IV... before you ask IV to answer you everytime you make demands. Update cannot be a date we can tell you when our bill is coming up. All our efforts are going to lead to that final result. It is the combined effort of every IV member that will produce results not just an effort of some small group of IV members. Every member of IV is important in the success of our organization.
We undestand that there is frustration and we too are frustrated due to retrogression and this is our motivation to work as a volunteer. We do ask members to contribute from time to time because it is needed in order to continue our struggle. Core members have not taken a single dollar on travel whenever they have travelled to DC or elsewhere. That itself is a testament to the personal dedication and sacrifice of some core members that have spent a lot of their savings till now. It was only in the recent MA event we were happy to hear invitation to stay in their places instead of hotel, from the IV membners that attended.
We try to update members and give them some realistic updates rather than speculations. Other lawyer websites and groups post some speculations to stir up their members and show that they are actively working. Pls. understand that we would like to give update when there is anything concrete to share. IV is on top of it and we are aggresively working and whenever we see even a small window of opportunity we jump on it and do whatever we can.
Pls continue to visit IV siteregularly so that you can see all the activites we are planning these days. After the MA event, this Thursday and Friday some core members are travelling to NJ to attend the event in Princeton. This weekend from 9 dec till 13 I will be in Indianapolis. So any local members that would like to interact with me for volunteer effort on the state chapter should contact me.

So are you saying that there is no need to depart and reenter the country prior to the end of the last date of your Parole in the case when you entered using the AP document (not a non-immigrant visa)? This appears grey and personally I'd rather err on the side of caution by atleast making a trip to Canada (if not to India) and reentering on the renewed AP.
AOS is your status- This allows you to stay in US as long as your application is pending/approved.

whether they are concerned with only a part of it or not, the fact that it appears on their website implies an endorsement of his views. if they are claiming there is a problem with H-1bs, then they need something to fix it, and matloff provides that.
this is exactly why we have to take advantage of it, and say that matloff also suggests this proposal for reform.
by the way, this would greatly benefit new H-1bs since it does not limit them to one employer. when you get out into the workforce you will understand how important that is
personally to me its an eyewash , i would luv to see matloffs reform go through its sounds gud , but by being realistic u gotta realise that nymbersusa aint about that, they'r just smartass's who'll work with what works 4 them, and again our co operation with them is not big enough for the senators to change anything, we'r a small part of the cog, its the corps who get stuff done/undone
