During our Infopass appointment yesterday, we insisted on speaking with a supervisor. He was also no help. All he kept repeating was the case has been approved and the card was in production but he won't be able to issue a letter or an Interim EAD. USCIS has completely done away with those. No changes in status since the first CPO email. Looks like we are in for a long wait. At the moment, my wife can wave a buh' bye to this job and start looking around all over again...it is extremely disappointing.

AC-21 can not be availed if I-140 is revoked by USCIS due to fraud.

Yes. AC21 doens't help if there is fraud detected in 140. Mine was a pretty straight forward case when it comes to credentials. I have filed in Master's Quota(EB2) with 3 years of experience . But if my employer did some thing else for Ability to pay or any other thing i can't help it..leave it to God..

I think Canadian PR would be useful if your destination country is Canada. What is the point in having a Canadian PR and travelling to USA. But again, this is just my assumption.

Hi there,
I personally seen two of my friends H1 (extension) got denied.
They both work for different desi companies, have been working ever since they are here in US. Have all the documents up to date required by USCIS...yet they got denied....
One friend's denial was because his education did not match his work...although he did his Engg in Comp. Sci. and working as an programmer analyst.
The other friend is awaiting for the reason...he came to know only couple of days ago, and he is literally in shock.
I dont know whats going on???!!!:(
What happens after H1 ext. is denied. IF a person has EAD, can he keep on working on EAD (AC21)?

If you know your approx filing date you can ask DOL for the H1B 7 th year extension proof...If they have your application they are most likely to respond in a few days...For more information on how to send that request please go to the DOL.gov website and look around a bit....

Multinationals have little choice but to expand their engineering operations abroad, and smaller businesses that can't afford to expand overseas are unable to hire the talent they need.
With the number of available visas drying up, there's no easy way for the current batch of international students to stay. This means they need to find jobs back home or in other countries. Additionally, there is already a backlog of more than a million skilled immigrants working in the U.S., mostly on H-1B visas, who are waiting for a yearly allocation of 120,000 permanent-resident visas. So we are headed for a massive reverse brain drain of skilled workers and students.
Our loss is likely to be the gain of countries like India and China.
All these students said they would discourage their friends from coming to the U.S.

Pappu, you are right about the points you made in your post. Unfortunately though, there are probably not too many of us. Moreover, most of us aged out students probably are not too experienced with these issues and most of us are probably busy finishing our college or attending grad school. But if there are any other aged out kids or parents of aged out kids in here that want to join in and support this, we all can form a sizable group to fight this by generating media storm ?!? But this is an important long term goal...
For now, there is a bill already introduced in congress. It will soon be debated and voted upon. Given the short amount of time we have, our best bet is to try to at least have some of the senators to notice this issue. I like the idea of meeting up with Senators. I'm going to try to meet up with my California senators/representatives. But for those who can't do this, we have to make sure we call/fax/email. Please don't give up hope. Dream act community has been vigorously calling in. So are the NumberUSA, ALIPAC and other anti-immigration groups.

Anyways, Section 4.(a).(1) is probably the most worrisome portion of this text because of the two words - 'Deportable' and 'Inadmissible' - that are used to describe the type of aliens that this act applies to. Here is the snippet...
(1) IN GENERAL- Notwithstanding any other provision of law and except as otherwise provided in this Act, the Secretary of Homeland Security may cancel removal of, and adjust to the status of an alien lawfully admitted for permanent residence, subject to the conditional basis described in section 5, an alien who is inadmissible or deportable from the United States, if the alien demonstrates that--

The words "inadmissible" and "deportable" does not only apply to undocumented students but others as well. So, if you are 'inadmissible' OR 'Deportable' and if you fall under the other guidelines, you will be eligible for this law. Now the main question is what does the keyword 'Inadmissible' mean ? Title 8 Chapter 12 Subchapter II, Section 1182 of the U.S. Code describes what 'Inadmissible Alien' means. Here is the link to this section :

(G) Student visa abusers

.According to this section, you violate the sections above and become inadmissible if you break one of the rules like taking less than 12 college units or if you don't apply for OPT and stay here after graduation etc. It is funny that we might have to become inadmissible in order to claim the benefits...but what can I say !
Perhaps, the main problem is that most of the senators think that students in this situation are all illegals. They are not aware of scenarios where legal children of H1B employees who are brought here as minors, are sometimes forced to become foreigners. Who ever came up with the AGE-OUT rule really is dumb...sorry to say this but I could not find any good reason behind this.
Anyways, I am not a lawyer of any sort. This is just my interpretation of the bill. I will need to contact a lawyer regarding this. This is most likely a side-effect of the bill or simply a loop-hole that is hard to refute...What do you guys think ? Please let me know if I am missing something here...

Some people are just vocal about disagreeing with the prevailing opinion and trying to sell theirs as the only salvation. There is no point in incessantly arguing with them.. after you have made your point its best to just ignore such arguments. Recognize that at the end of the day we are all just armchair critics. Ultimately, the core team members are the ones who are aware of the ground situation as it evolves and I trust they will do what is best for all of us.
Well apparently it is not just those groups who think that way, brb2 on this forum told me that there is a law that requires me to carry identification papers all the time!
Although there are some sane voices here, what is becoming clear to me is that those who want to water down the skil Bill (and call it SkUL bill), those who think there is nothing wrong in the law that requires non-citizens to carry papers, and those who criticize me for comparing the anti-immigrants to KK are becoming a vocal minority. Or maybe a majority?

On AOS, I think I would hold my 1040 and spend $340 to file a EAD for my 10-year-old son and get a SSN and get $300 back. Last year, we got the child credit with ITIN but I am not sure about this year. This country has gone too far.

A. No. To qualify for the extra credit for qualifying children, not only do the taxpayer and spouse, if filing jointly, need valid Social Security Numbers, but the qualifying child must also have a valid Social Security Number.
