Yes, it is possible that they might consider legal immigration within an enforcement only bill.
I recently wrote to my House Rep expressing the need for Skill bill; I urge all of you too.
For those who think there is opposition to H1-B, please call Lou Dobbs.
(I know there is some opposition to it, but Skil bill was recently introduced by a republican as well. So there is no reason to lose hope.)

Those who know/have friends in Iowa, please urge your friends to call Rep. King. We need to mobilize Iowans to call Rep King for him to get an idea how many Iowans are affected by this. Des Moines comes in the 3rd district and even though it is not Rep. King's (5th) district, we should try get reach our friends in the Insurance Capital of the country. I have already passed this on to my friends in Des Moines. There are thousands of tech workers working there. Please send it to whoever you know there and urge them to call.

Check out this firms website and see who their other clients are:
1. Advanced Systems Technology: a bunch of small programming/IT firms: for or against us ... duh
2. Sabre Inc: a bunch of small manufacturing firms for automotive, medical and consumer products...see above comment
3. NATIONAL LEAGUE OF POSTMASTERS: who got their bill passed in the lame duck session
So, the question is to find the strongest lobbying firm that can fight these guys
Plus who are the lobbysts for AILA and the technology firms? If we can befriend them, we can make sure our EB demand does not get overidden.

I went thru the doc list & I had a few questions for the experts out there :
1) Do I need all my I -94 s or just the latest ?
2) I dont really have a birth certificate, can some document like the Std X / School leaving etc substitute along with a notarized statement ?
3) What is with the medical records ? What records would I need ?

I have a Birth Certificate situation similar as above. I was born in an area of India where it is not possible to go now due to naxalite activities. So I cannot even get a Non-Availability of BC. I do have 10th certificate and School LC and affidavit from my Parents. Should these suffice?

Master's + 5 years IT Exp in India. Wife also had similar background.
Nov 1998 - Came to US in with wife and 1 yr old daughter to work for an American Consulting company.
Jun 1999 - Declined Employer's offer to file for GC.
Oct 1999 - Wife started working on H1-B.
Oct 2000 - Wife's employer filed for GC.
Jun 2001 - Wife's Labor and I-140 approved. Lawyer sent I-485 forms for completing.
Jun 2001 - Wife is in labor again, my son is born.
Oct 2001 - Wife considered quitting before the end of family leave, got laidoff, we were happy with severance, since we were planning on going back to India anyway.
May 2003 - Bought a house, because my daughter wanted to live in a home that had stairs and I could not explain about GC to a 6-year old :)
Aug 2003 - Realized that going back is not easy. Labor filed. Company lawyers too lazy to file under EB-2, I also did not bother too much about the category then.
Mar 2006 - Getting frustrated that she is not able to work, wife and kids went back to India. Plan was for me to go back too, but I was too lazy to look for a job and work in India.
May 2007 - Labor approved.
Jun 2007 - I-140 approved (Premium processing).
July 2007 - Wife quits her job in India. Wife and kids come back.
Aug 2007 - Filed I-485
Nov 2007 - Got EAD and AP.
Aug 2008 - 2Yr EAD for both.
Sep 2008 - Daughter is 11, Son is 7. I am still with the same employer, happy with what work I do. Looking forward toward the 10-year anniversary gift :)
Never have I worried too much about my GC, even now, I do not care much. There is no point in worrying about things that are not in my control. There are not many things I wanted to do but could not do because of lack of GC. I think, that my employer has not discriminated against me in anyway based on my immigration status. Since I work for a medium-sized American company, the managers (I have seen too many of them) do not even know that I am on H1. I deal directly with the immigrations dept for any immigration related matters.
My take on GC has been : You "need" a GC only when you do not have one. GC is too small a issue to get depressed about, people around the world face and solve much bigger issues on a daily basis. So what if I do not get a GC or it is delayed, I am ready to face the situation and deal with it. GC is not life, it is just a very small part of it.
I do not mean to undermine IV's efforts in anyway, these are just my personal thoughts. I just cannot stand the continuous and unreasonable complaining people do just because their GC is delayed.

I agree. Life on EAD/AP is just as if you had a green card - except you can not start your own company. But one can keep changing jobs, promotion etc. The con is that one has to apply for EAD/APs each year meticulously. If the employer is paying then even that is a minor irritant.
But as the saying goes the grass on other side always looks greener. Once you get to file 485 and get benefits of AC-21, one wants the green card, and then one longs for the Citizenship to get over the hassles of keeping documentation at all times. Once one gets citizenship people then forget about others in the queue and soon forget the trials and tribulations they underwent:)

I think the root cause of EB3 India is not that there are too many EB3 India applicants but majority of the ROW EB applicants apply in EB3 and not EB1/2 even if they qualify (this might change now as EB3 ROW is suffering huge backlog).
Yes godalguru theres a possibility that EB3 ROW starts jumping to EB2 ROW. But I dont think they start doing it right away.

Began GC discussions as company was willing to sponser in 1999 but I very foolishly did not follow through on the discussions. Back then, I had no sense of urgency whatsoever.
Was told I had a file for GC in July 2003 before I started my 6th year on H1 ... and that is when my journey began. EB3 labor cert was filed then.
Filed for I140 in April 2007 premuim processing - was approved.
File for I485 in June 2007.
Switched companies in Aug 2007 as my employer of 9yrs was in a serious tailspin with massive layoffs. Filed concurrent I140 and I485 with new company in July 2007. Used labor substitution for I140 with PD of Dec 2002 - premium processing for labor subs had been banned at this point.
My I-485 PD dates are current but I have been languishing I-140 queue that seems to not move.

My husband's application has PD of March, 2004. Applied from Texas and still waiting for LC. The BEC shows status of IN PROCESS and Processing Type is TR. The information at BEC that by Sep 30,2007 all of them should be cleared - does it apply to TR as well, or only to RIR?
Now, since all the categories are made current, is there any way to speed up the process?
