We truly dont care if we can get all the goodies or not - something is better than nothing as far as we are concerned. The starting point is for the lawmakers to SCHEDULE the bill first - what can be passed and what cannot will be decided by the (endless) debates in house and senate. I dont think the decision to schedule a bill is based on what its opponents/supporters think - if that were the case CIR would never even have been discussed, let alone passed by the senate. To the best of my knowledge, scheduling any bill is upto the respective house and senate judiciary committee /immigration sub-commitee chairmen, the majority/minority leaders and the unavoidable backroom politics that is always involved. Thats the first bridge to cross.
Point being, now is not the time to wonder if we are asking "too much". In any case, I would think the big corporates - the true drivers of SKIL - pretty darn know what the hell to ask and how to get congress to pass it. What is out of theirs - and our- hands is the politics of it all.
Looks like the recent news is not good for CIR or Skill bill. It may take atleast 4 months or more for immigration reform if anyone lobbying for cIR or SKill. CIR is so much complicated and no end for discussion. Similarly Skill bill is asking too much on immigration numbers mainly for H1. raising H1 numbers to 115k may be easy to pass. But problem is market based increase and exemption to MS people. Those will have huge impact in future. Because now Universities staring to to allow 3 year degree for MS. People can fear that too much h1 can reduce job demand and bring down wages. Infact it is going to be problem for current H1 people also if US allows unlimted number of H1. In that environment only companies like TCS,Wipro can do well. So correct number is needed to balance between demand and supply. Because of high visiblity to H1 program EB relief also got caught. If any bill which gives EB relief then that may be easy to pass but people need to be cautious on numbers. Certainly Exemptions for MS or STEM will not get support and that will negatively impact the probablity of passage. Any case if numbers are too much then there will be huge opposition from anti immigrants and Labor unions. If we lobbey for moderate increase then chances of passing is bright. Anyhow it is upto people who is lobbying. From 2005 all the immigration bills failed. There were opinion that Republican House is main reason. That is true cerrtain extent. Anyone can compare the immigration increase or past 30 years. The successful legislation were only when numbers were more moderate.

We started a membership campaign in Colorado two weeks back. The idea we have used is 1:1 campaign. In two weeks we have grown from 24 to 40 members. Just start from the place where you work, make a list of afected people, call a meeting, give your state chapter yahoo group address and IV address, and ask people to join.
From the attendees, ask if someone has a friend in some other company. Make that person a contact point for that company and let the same type of meeting happen in that other company. This way slowly members will start joining the state chapters.
Its a slow process but it works. Sending an email to your friend will not work unless and untill some one talks to them 1:1 and explain that if they don't stand up for their rights ... no one else will.

Can some one clarify me why the heck you guys keep repeating that "screwed" word for applying under new system ???
Is this because of the frustration that we have to restart the entire process and loss of money or its because the new system is not good enough ???

Here is my suggestion to who ever complianing about the current situation.
1. The situation created by us. We are future immigrant by our choice. We are going through a system, some may say broken, not working, inefficient, but still system is there. If you want to raise your voice, do it loudly, so that people can listen.I don't know what is the desibel of the voice . If you cannot, then sail through the system.
2. For EB3 I&C, best option will be upgrade skill may be through education or exp and port the EB3 to EB2 and make clog EB2. After sometime, you will get same benift as EB2. So EB3 crowd will be reduce. Then EB2 will be retrogate and EB3 I&C will be current. Flow of Visa number will be as usual.

guys..dont be too much happy about the EB2 ..the TSC actual processing dates are April 2006 and not July 2007 as shown on processing dates website..i checked with USCIS customer service and they mentioned that the dates shown on USCIS website are not current. The USCIS customer reps have the current dates of processing and that is April 2006....

You need to get certificate from US agency(anywhere in USA) that will prove that your earned degree/diploma is equivalent to B.S in Computer or Electrical engineering done in any USA. I have applied for EB2 with B.S + 5 years of experience and to prove B.S equivalency I send letter from agency as a proof. I dont remember agency name but there are plenty in and around USA. I will post name of the agencies in my next post.

Thanks invincibleasian and macaca. I am working as a contractor. So I cannot stick to one place as I need to move to places where ever I get the project. I see the only option for me is to do the online MS.
1) Does any one knows the list of universities which allows to do online MS?
2) I am B.com graduate (Bachelor of Commerce, whis is 3 years degree) and done LLb (Bachelor of Law which is 3 years degree). Will it fulfill the eligibility requirments of 16 years education in order to do MS?

Rightly said Devils_Advocate !!, one more thing is many Republicans support CIR too but still we dont have 60 votes to pass this measure.
Unfortunately, This measure is bound to fail when unemployment is 10% and politicians dont want to anger their base in an election year.
Hate to be the party pooper, but its better to see the reality than be lost in the illusion. The facts:
We a have bitterly and an acrimoniously divided Congress
The democrats are NOT together on this one i.e blue dogs, conservative Dems etc.
We have game changing mid terms coming in.
Democrats DONT have super majority in the Senate any more.
And MOST of all we have a president who has PUBLICLY said that this bill will not pass this year due to the lack of political clout.
This is just a ploy to rally up the hispanic votes by Reid, don't pin too much/any hopes on this, the writing on the wall is unfortunately very clear, not worth the heart break. :(

my 485 received date is july 2nd 2007
but when i check the status the automated voice is sayaing that they received the application on 31st july 2007. Can someone please clarify this.and what are my chances of approval in august.

Assuming SA2238 passes... It will be the end of 'Contracting' for all practical purposes. A bonaza for outsourcing companies! Lots of projects and positions are going to get outsourced. Some projects may be moved off-site, as in big contracting companies doing actual work in their premises, some will go to India. some H1Bs may be lucky to be hired as "direct employees" by the clients, those who can will switch to EADs (which don't have such restrictions). For others, it'll be the end of the road.
so what does this mean now? I have little less than 3 yrs left on my H1b and I just started my GC process. Does that mean once I finish my 6 yrs, getting an extension will be a problem? Again I am assuming SA2238 will go through by that time....
Also, I have heard that in california H1b extension beyong 6 yrs is being rejected already stating that you cannot sub-contract on H1B
